七　当該特別養護老人ホームの開設者の役員又はその長のうちに次のいずれかに該当する者があるとき。

(vii) when any Officer, etc., or the chairperson of an organizer of said Intensive Care Home for the Elderly corresponds to any of the following:２

前項ただし書の規定は、被保護者の意に反して、入所又は養護を強制することができるものと解釈してはならない。

(2) The provisions of the proviso to the preceding paragraph shall not be interpreted as those that are able to force admission into a facility or provision of nursing care against the will of a public assistance recipient.

政府は、児童虐待を受けた児童の社会的養護に関し、里親及び児童養護施設等の量的拡充に係る方策、児童養護施設等における虐待の防止を含む児童養護施設等の運営の質的向上に係る方策、児童養護施設等に入所した児童に対する教育及び自立の支援の更なる充実に係る方策その他必要な事項について速やかに検討を行い、その結果に基づいて必要な措置を講ずるものとする。

(2) The Government shall promptly examine a scheme about an expansion of foster parents and foster homes, etc., a scheme about an improvement in quality of management of foster homes, etc. Including prevention of child abuse in foster homes, etc., a scheme about enrichment of education and supporting independence of children in foster homes, etc., and other necessary matters, and shall take necessary measures based on the result of the examination.
