第二十一条 本邦に在留する外国人は、現に有する在留資格を変更することなく、在留期間の更新を受けることができる。

Article 21 (1) Any alien residing in Japan may, without changing his/her status of residence, have his/her period of stay extended.

申請人が法別表第一の一の表若しくは二の表の上欄の在留資格、文化活動の在留資格又は留学の在留資格をもって在留する者の扶養を受けて在留すること。

The applicant must be a dependent of a person residing in Japan with a status of residence listed in the left-hand column of Appended Table I (1) or (2) of the Immigration Control Act or with the status of residence of "Cultural Activities" or "College Student".

我が国に在留する外国人が，現に有する在留資格の活動を変更することなく，在留期限到来後も引き続き在留しようとする場合には，在留期間更新の許可を受ける必要がある。

Any foreign national in Japan who desires to stay longer than the period of stay originally permitted without changing his/her status of residence must obtain permission for an extension of the period of stay.

３第一項の外国人が在留することのできる期間（以下「在留期間」という。）は、各在留資格について、法務省令で定める。この場合において、外交、公用及び永住者の在留資格以外の在留資格に伴う在留期間は、三年（特定活動（別表第一の五の表の下欄ニに係るものを除く。）の在留資格にあつては、五年）を超えることができない。

(3) The period during which an alien may reside as set forth in paragraph (1) (hereinafter referred to as "period of stay") shall be determined for each status of residence by a Ministry of Justice ordinance; and when the status of residence is one other than that of diplomat, official or permanent resident, the period of stay shall not exceed 3 years (5 years in the case of the status of residence of "Designated Activities" (except for those related to d. in the right-hand column of (5) of Appended Table I).

４第二十条第四項の規定は前項の規定による許可をする場合に、同条第五項の規定は第二項の規定による申請があつた場合に、それぞれ準用する。この場合において、同条第四項中「新たな在留資格及び在留期間を記載させ、」とあるのは「新たな在留期間を記載させ、」と、「新たな在留資格及び在留期間を記載した」とあるのは「在留資格及び新たな在留期間を記載した」と、「新たな在留資格及び在留期間を記載させる」とあるのは「新たな在留期間を記載させる」と読み替えるものとする。

(4) The provisions of Article 20, paragraph (4) shall apply mutatis mutandis to permission pursuant to the provisions of the preceding paragraph, and the provisions of the same Article, paragraph (5) shall apply mutatis mutandis to an application pursuant to the provisions of paragraph (2), respectively. In this case, "enter the new status of residence and period of stay in the passport," in paragraph (4) of the same Article shall be deemed to be replaced with "enter the new period of stay in the passport". In the same paragraph, "with the new status of residence and period of stay," shall be deemed to be replaced with, "with the status of residence and the new period of stay". In the same paragraph, "enter the new status of residence and period of stay in the previously issued certificate" shall be deemed to be replaced with "enter the new period of stay in the previously issued certificate".
